This complex transaction required our comprehensive "one-stop" service, which included:
Lease Renewal: Initially, we were instructed to negotiate a new lease for the existing premises at St James St, Derby, following the Landlord’s Section 25 Notice. However, upon review, the premises were found to be excessively large due to unused upper floors, prompting the decision to seek alternative locations.
Acquisition: We conducted a thorough search for suitable alternative premises, offering several options. After extensive negotiations and an abortive transaction, we secured the former RBS Bank at Cornmarket, Derby. This new location boasts a superior position, better frontage, and a more suitable configuration.
Dilapidations: The Landlord of the existing premises issued a Schedule of Dilapidations exceeding £125,000. We appraised the lease through our consultancy, Dilapsolutions, and identified the Tenant’s obligations. By applying the principles of Section 18 (1), we successfully negotiated a settlement for less than half of the initial claim before vacating.
Schedule of Condition: During negotiations for the new property, we agreed to limit the Tenant’s repairing obligations for the basement by incorporating a comprehensive photographic schedule of condition into the new lease. Dilapsolutions provided this swiftly to ensure no delays in documentation.
