Instructions were received from a former Tenant to negotiate a dilapidations claim at their former industrial premises.
The Landlord served a Schedule of Dilapidations at £92,426.
On behalf of the former Tenant, our Building Surveyor assessed the Schedule at £25,000.
The Landlord’s claim included VAT. Although the Landlord could not recover VAT, our stance was that any hypothetical purchaser would elect the property for VAT and therefore be able to recover this on any sums spent.
Utilising our market knowledge, we concluded that many of the items of works claimed would be superseded by inevitable improvements that were required in order to relet in the modern context. In light of this, we arrived at a Diminution of £20,000.
A settlement was then reached at £20,650, providing the client with a swift conclusion at considerably less than the Landlord’s original Claim.
