We were instructed to negotiate a claim on behalf of a Tenant for an end-terrace industrial unit in an established industrial location
The Landlord had served a Schedule of Dilapidations Claim (a report that provides a precise breakdown of repairs that must be scheduled to reinstate a property to its original condition as stated in the lease agreement) at £79,730.
Our Building Surveyor’s response was a total sum of £17,000.
The above opposing figures between Building Surveyors ordinarily set the parameters, with the eventual settlement sum, therefore, commonly being between the two. However, as we are the only dilapidations consultancy which also employs specialist Valuation Surveyors who, at no additional fee, automatically apply the law which caps payments to the lower impact on the property’s value, we secure the lowest achievable settlement sums.
The claim was settled at £15,000.
The subject property formed part of an industrial estate where it was common knowledge at some point in the next 2-3 years, the Landlord would redevelop. Therefore the only market for the subject property was a short-term letting, after which it would be demolished. This meant very few of the works claimed by the Landlord would be ‘value affective’ and required to be undertaken to satisfy a short-term occupier.
